This gal is a Black and Yellow Garden Spider, Argiope aurantia. The males don’t make the big webs, their focus is on mating, not eating. Females like yours are usually head-down in their orb webs. Soon she may make an egg sac near her web. The babies are freeze-resistant and won’t emerge from the sac until Spring.
