Hi, this is a particularly pretty cross orbweaver, Araneus diadematus. It has venom intended for its insect prey. Most spiders have venom, it is a matter of level of potency to humans, not a yes/no thing. Most, like your spider, are unlikely to bite except in self-defense. If your skin is near her egg sacks or hatchlings she might bite to defend them. If your skin traps her or presses against her she might bite to avoid being squished. Otherwise, orbweavers will just do their insect eating and avoid physical interaction with people and pets.
