They are not harmful, and even if you accidentally run into their web, they will most likely scamper away. They only bite when you actually try to hurt them, and their bite is not medically significant. Btw, good picture!

It is in a flowerbed next to busy sidewalk. Very noticeable with its light orange color. I hope people let it be there peacefully.
In my experience most people don’t kill orbweavers like they thoughtlessly kill spiders that look more like what they imagine scary spiders to look like. It is difficult to get digital cameras to autofocus on spiders. The camera goes for the background depth instead. My previous out-dated digital cameras had manual focus as an option. I miss that. A way to work around that is to put a blank background behind the spider, like a briefcase or purse, piece of paper, or tree trunk.
